These Terms and Conditions (“Terms”) govern your access to and use of www.binbroad.com (the “Website”) and your purchase of products offered through the Website.

By accessing the Website, creating an account, or placing an order, you agree to be bound by these Terms and the policies incorporated into them by reference.

If you do not agree with these Terms, please do not use the Website or place an order.

Nothing in these Terms limits or excludes any mandatory consumer rights available under applicable law.

Any material substitution affecting product fitment, function, specifications, or value will not be made without the customer’s agreement.

We may correct product information before accepting an order. If a material error is discovered after an order has been placed, we will contact the customer where appropriate.

Nothing in this section limits our responsibility for products that are incorrect, defective, unsafe, misdescribed, or otherwise non-conforming.

 

3. Vehicle Manufacturer References

References to vehicle manufacturers, trademarks, model names, OEM numbers, OE numbers, or part numbers are used solely for product identification, comparison, and compatibility purposes.

Unless expressly stated otherwise, these references do not mean that:

• The product is manufactured by the referenced vehicle manufacturer.
• The product is an original equipment product.
• BINB ROAD is sponsored, authorized, endorsed, or affiliated with the referenced manufacturer.
• The referenced manufacturer has approved the product.

All third-party trademarks and brand names remain the property of their respective owners.

 

4. Pricing, Taxes, and Availability

Prices are displayed in the currency shown or selected on the Website.

The final amount payable will be displayed during checkout before the order is submitted.

Prices may change without notice before an order is accepted. Price changes will not affect an order that has already been accepted, unless the customer agrees or applicable law permits otherwise.

Depending on the delivery destination and applicable tax rules, the checkout price may include:

• Product price.
• Sales tax, VAT, GST, or similar taxes.
• Delivery charges.
• Duties or import charges collected in advance.

If import duties, taxes, customs charges, or brokerage fees are not collected during checkout, they may be payable by the recipient upon importation, as further explained in our Shipping Policy or checkout information.

Product availability is not guaranteed until an order has been accepted.

BINB ROAD may:

If we cannot fulfil an order for which payment has already been collected, the applicable amount will be refunded to the original payment method.

Orders are subject to acceptance by BINB ROAD.

Submitting an order constitutes an offer by the customer to purchase the selected products subject to these Terms.

An automated order acknowledgement confirms that we have received the order. It does not necessarily mean that the order has been accepted.

Unless applicable law requires otherwise, a sales contract is formed when BINB ROAD:

• Sends a shipping confirmation;
• Expressly confirms acceptance of the order; or
• Dispatches the product,

whichever occurs first.

Before accepting an order, we may review:

• Product availability.
• Payment authorization.
• Billing and delivery information.
• Shipping availability.
• Vehicle compatibility information.
• Pricing or catalog errors.
• Fraud, payment, export, import, or legal compliance risks.

We may decline or cancel an order before acceptance for legitimate reasons, including:

• Suspected fraud or unauthorized payment.
• Payment authorization failure.
• Incorrect or incomplete customer information.
• Inventory shortages.
• Obvious pricing or catalog errors.
• Delivery restrictions.
• Violation of these Terms.
• Legal or regulatory restrictions.

Payment must be successfully authorized before an order is processed.

If we cancel an order after collecting payment, the applicable amount will be refunded to the original payment method.

Nothing in this section limits any statutory right to cancel or withdraw from an eligible purchase.

 

6. Vehicle Compatibility and Installation

BINB ROAD specializes in automotive replacement parts.

Automotive parts may vary according to:

• Vehicle model year.
• Production date.
• Engine.
• Drivetrain.
• Trim level.
• Chassis code.
• Body style.
• Market specification.
• Original equipment configuration.
• Previous vehicle modifications.

Before ordering, customers should review and compare:

• The reference OEM or OE number.
• Product photographs.
• Dimensions.
• Connector types.
• Installation position.
• Vehicle specifications.
• Fitment notes and exclusions.

To help confirm compatibility, we strongly recommend providing:

• Vehicle Identification Number (VIN).
• OEM or OE part number.
• Engine information, where applicable.

BINB ROAD may assist with compatibility verification based on the information supplied by the customer. This assistance does not replace inspection or verification by a qualified automotive professional.

The customer is responsible for providing complete and accurate vehicle information.

If a customer orders an incompatible product without requesting compatibility verification, and the supplied product matches the order and published description, the return may be treated as a customer-initiated return. The customer may therefore be responsible for return shipping costs.

This does not affect the customer’s rights where BINB ROAD supplied an incorrect product, provided materially incorrect compatibility information, or delivered a product that does not conform to the contract or product description.

Automotive products should be inspected before installation and installed by a suitably qualified professional where appropriate.

A product that appears incorrect, damaged, defective, incomplete, or unsafe must not be installed or used.

 

7. Shipping, Delivery, and Risk

Shipping methods, delivery estimates, tracking information, delivery restrictions, customs information, and address requirements are described in our Shipping Policy and, where applicable, during checkout.

Delivery dates and transit times are estimates unless BINB ROAD expressly agrees to a guaranteed delivery date.

Delivery may be delayed because of:

• Carrier disruption.
• Customs clearance.
• Severe weather.
• Remote delivery locations.
• Public holidays.
• Incorrect or incomplete addresses.
• Regulatory inspections.
• Events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address, recipient name, telephone number, postal code, and any apartment, unit, building, or access information required for delivery.

Address changes cannot be guaranteed after an order has entered processing or has been dispatched.

For consumer orders, risk of loss or damage generally remains with BINB ROAD until the customer, or a person designated by the customer other than the carrier, takes physical possession of the goods, unless applicable law provides otherwise.

If the customer independently appoints a carrier that was not offered by BINB ROAD, risk may transfer when the goods are delivered to that carrier where permitted by applicable law.

Delays outside our reasonable control do not affect any mandatory right to cancel an order, obtain a refund, or receive another remedy where delivery is not completed within the period required by applicable law.

 

8. Cancellations, Returns, Exchanges, and Refunds

Cancellations, returns, exchanges, and refunds are governed by our Return Policy, which forms part of these Terms.

Customers should review the Return Policy before requesting a return or exchange.

Customers must contact BINB ROAD before sending any product back so that the correct authorized return address and instructions can be provided.

The address shown on an original shipping label, the dispatch address, or the company information page is not automatically an authorized return address.

Consumers in the European Union, European Economic Area, United Kingdom, and other jurisdictions may have statutory withdrawal or cancellation rights in addition to our commercial return policy.

Nothing in these Terms or our Return Policy limits rights relating to products that are:

• Defective.
• Damaged.
• Incorrect.
• Unsafe.
• Misdescribed.
• Otherwise non-conforming.

 

9. Commercial Warranty

Unless otherwise stated on the product page or in our Warranty Policy, eligible BINB ROAD products are covered by a 12-month limited commercial warranty beginning on the date of delivery.

The commercial warranty covers confirmed defects in materials or workmanship occurring under normal and intended use.

Unless applicable law requires otherwise, the commercial warranty does not cover:

• Normal wear and tear.
• Improper installation.
• Incorrect diagnosis.
• Accidents or collision damage.
• Abuse, misuse, or neglect.
• Racing, competition, or off-road use unless specifically advertised for that purpose.
• Unauthorized modification or repair.
• Damage caused by another defective vehicle component.
• Corrosion, contamination, or fluid damage not caused by a product defect.
• Use for a purpose other than the product’s intended purpose.

Under the voluntary commercial warranty, BINB ROAD may provide repair, replacement, partial refund, or refund depending on the circumstances and the terms of our Warranty Policy.

Unless required by applicable law, the voluntary commercial warranty does not cover labor, installation, removal, diagnosis, towing, storage, vehicle rental, loss of use, or other related expenses.

These exclusions apply only to the voluntary commercial warranty and do not exclude any costs, remedies, or rights that BINB ROAD must provide under mandatory law.

The 12-month commercial warranty is provided in addition to, and does not replace, reduce, or limit, any statutory consumer rights.

 

10. Intellectual Property

All Website content, including but not limited to:

• BINB ROAD branding and logos.
• Text and product descriptions.
• Product images.
• Graphics and icons.
• Videos.
• Website design and layout.
• Databases and software.
• Marketing materials.

is owned by BINB ROAD, licensed to BINB ROAD, or otherwise used as permitted by law.

Website content is protected by applicable copyright, trademark, database, and other intellectual property laws.

Without prior written permission, you must not:

• Copy, reproduce, republish, sell, or commercially distribute Website content.
• Remove copyright, trademark, or ownership notices.
• Use BINB ROAD branding in a misleading manner.
• Use our photographs or descriptions to advertise competing products.
• Suggest an affiliation, sponsorship, authorization, or endorsement that does not exist.

You may view and use the Website for legitimate personal or business purchasing purposes.

 

11. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

• Fraud or fraudulent misrepresentation.
• Willful misconduct or gross negligence where applicable.

• Defective-product liability that cannot legally be excluded.

For consumers, BINB ROAD remains responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill, to the extent required by applicable law.

BINB ROAD is not responsible for losses caused by:

• Incorrect or incomplete information supplied by the customer.
• Improper diagnosis, installation, repair, modification, or use.
• Continued use after a defect or safety concern became apparent.
• Normal wear and tear.
• Another defective vehicle component.
• Unauthorized third-party conduct.
• Events outside our reasonable control.

To the maximum extent permitted by applicable law, BINB ROAD will not be liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable when the contract was formed.

BINB ROAD is not responsible for business losses suffered by a consumer who purchased the product primarily for personal use.

For business customers only, and to the maximum extent permitted by applicable law:

• BINB ROAD will not be liable for loss of profit, revenue, business, contracts, opportunity, goodwill, data, or anticipated savings.
• BINB ROAD’s total aggregate liability arising from an order will not exceed the amount paid for the affected product.

The limitations in this section do not reduce any mandatory remedies available to consumers.

 

12. Website Availability and Third-Party Services

We strive to keep the Website secure, accurate, and available, but we do not guarantee uninterrupted or error-free access.

If a provision of these Terms conflicts with mandatory consumer law, the mandatory law will apply to the extent of the conflict. The remaining provisions will continue in effect.

These Terms and contracts formed through the Website are governed by and construed in accordance with the laws of the People’s Republic of China as applied in Mainland China.

However, this choice of law does not deprive a consumer of any mandatory protections available under the laws of the country or region in which the consumer habitually resides.

Nothing in these Terms restricts a consumer’s right to bring a claim before a court, regulator, consumer authority, or dispute-resolution body having jurisdiction under applicable mandatory law.

Before commencing formal proceedings, customers are encouraged to contact BINB ROAD Customer Support so that the parties can attempt to resolve the matter directly.

For business customers only, any dispute arising from or relating to these Terms, the Website, or an order shall be submitted to the competent courts at the registered location of the contracting entity identified on our Company Information page, unless otherwise agreed in writing.
